GENERAL RULES OF THE BOURGOGNE VELO FESTIVAL

Presentation of the event

The association "Ride in the Red Zone" (National Register of Associations: W783010605 - SIRET: 84929781700017), whose head office is located at 14 Chemin du Trou à Glaise, 78540 Vernouillet, organizes Saturday 10 and Sunday 11 July 2021, in Tournus (71), the BOURGOGNE VELO FESTIVAL.
This event takes place on the public roads of the department of Saône-et-Loire and Ain, kept open to traffic. The place of departure and arrival of the cycle routes is located on the site of the BOURGOGNE VELO FESTIVAL, in Tournus, on the banks of the Saône, near the Louis Desmaris sports complex.

Two routes are available from Tournus:

  1. "Les Boit Sans Soif" - 60 km circuit - Difficulty level: 4/5 (departure on Saturday July 10 at 10:00 am)

  2. "Les Ventres Jaunes" - 60 km circuit - Difficulty level: 3/5 (departure on Sunday July 11 at 10:00 am)

Definition

The term "participants" is understood, within the meaning of these regulations, as all natural or legal persons having subscribed to a commitment to participate in the Bourgogne Vélo Festival event which will take place on Saturday 10 and Sunday 11 July 2021.

Article 1 - conditions of participation

The online sales service of the Bourgogne Vélo Festival ticket office as part of participation in one or more of the hikes is provided by the "Ride in the Red Zone" association via the Hello Asso internet platform.
The association "Ride in the Red Zone" registered in the Trade and Companies Register of Versailles under number 849 297 817 00017, represented by Mr. Ludovic BRUILLOT, as Chairman, duly authorized for the purposes hereof.
Any reservation made with the "Ride in the Red Zone" association implies unreserved acceptance of these general and special conditions, which the customer acknowledges having read.

Article 1.1 - Conditions of participation in the circuits of the Bourgogne Vélo Festival

The price of the ticket is indicated per person. The price of the services offered is in euros, VAT and service included. The price applicable to the sale of each product will be that in force on the day of purchase.
Participants in the Burgundy Vélo Festival hikes (Saturday 10 and Sunday 11 July 2021) must imperatively have paid the commitment (variable amount depending on the hike chosen) with the association "Ride in the Red Zone ". It may be possible to register in the Festival village in Tournus (banks of the Saône) on July 10 and 11, 2021, subject to places still available. To participate, people under the age of 18 must be accompanied by a responsible adult and wear an approved helmet. Minors under the age of 16 are not allowed to participate in cycling tours.



There is no provision for a reduced rate for students, unemployed, etc. Two scenarios:

  • Those who wish to participate fully and benefit from all the services provided for in article 2.1 (tasting stops, musette, gift, etc.) will register at the price indicated above,

  • Those who choose to participate freely in the courses may do so but will not benefit from the services provided for in article 2.1.

Article 1.2 - Equipment required to participate in the Bourgogne Vélo Festival

Once engaged, participants must imperatively ensure that their bicycle complies with the rules for participating in the Bourgogne Vélo Festival hikes. The bicycle used by participants must in particular have a braking system in good working order, as well as tires suitable for the route for which the participant has registered.

As this is an event reserved exclusively for old or vintage-inspired bikes, participants must comply with the following rules concerning their bike and their clothing:

  • Bikes allowed:

    • Vintage bikes (before 1987): steel or other alloy frame (carbon not accepted), with gear change system on the frame, cables passing outside the frame, classic brake pad system (no brakes disc), classic flat pedals with or without toe clamp and strap (no self-fixing pedals).

    • Historic-inspired bikes: frame in steel or other alloy (carbon not accepted) including original or vintage-inspired components.

  • Dress code: all participants are strongly encouraged to wear vintage cycling clothing, such as woolen jerseys, bib shorts with chamois, helmets with leather straps, matching caps. Participants using a bike other than a racing bike (ie tandem, carrier) will adopt a sober and chic vintage look. Modern cycling clothing made from technical fabrics (ie lycra) is strongly discouraged.

  • Accessories: participants will take care to choose their accessories (shoes, hats, bottles, etc.) carefully in order to maintain a certain homogeneity / consistency with their bike / outfit. The only modern accessory authorized / recommended is the helmet in order to guarantee everyone's safety.

Only muscle bikes are allowed.

The use of mountain bikes and electrically assisted bicycles (VAE) is not accepted.

Participants who show up with bikes, clothing and accessories that do not comply with the recommendations detailed above will be refused the start of the hikes, and will not be able to claim reimbursement of their registration fees.

Article 1.3 - Registration and payment

Online registrations will be made from the site www.helloasso.com within the limit of the gauges (maximum number of participants) provided for each circuit. Payment is made exclusively by credit card.
Online registrations will be open from Sunday, June 6, 2021, at 8:00 p.m. Registrations will be accessible online until Wednesday, June 30, 2021, 8:00 p.m., subject to availability.
No reservation will be made by phone or at the counter of the Tournus Tourist Office.
Registrations on site in the Festival village in Tournus from July 10 to 11, 2021 may be possible, subject to places still available.



Article 1.4 - Booking confirmation

Once the transaction has been completed, participants will receive a payment confirmation by email and the vouchers corresponding to the services purchased.

Article 1.5 - Proof

It is expressly agreed that, unless proven otherwise, the data recorded in the information system constitute proof of all transactions concluded with customers, so that they will be admissible, valid and enforceable between the parties of the same. manner, under the same conditions and with the same probative force as any document which would be drawn up, received or kept in writing.

Article 2 - commitment

Article 2.1 - How to register for the Bourgogne Vélo Festival hike

The commitment to the Bourgogne Vélo Festival hikes (Saturday 10 and Sunday 11 July 2021) is firm and final. No refund will be applied once payment has been made.

Beyond access to the course, the commitment includes the following services:

  • the musette,

  • The roadmap,

  • the frame sticker,

  • coffee / croissant before the start of the hikes,

  • the refueling (s), depending on the route,

  • the arrival snack,

  • promotional items and documents offered by the partners of the Bourgogne Vélo Festival,

  • Finisher's gift,

  • participation in the raffle.

The commitment does not include:

  • lunch (at the expense of the participants - "meal from the bag"),

  • liability insurance. Each participant. must ensure that he / she is well covered by his / her Insurance for the damage that he / she may suffer or cause to other participants and to any other person outside the event throughout the duration of the hike cyclist.

Article 2.2 - Withdrawal

Under the provisions of article L221-28 of the Consumer Code, the right of withdrawal is not applicable.

Article 2.3 - Cancellation - modification of the registration

The commitment to the Bourgogne Vélo Festival hikes (Saturday 10 and Sunday 11 July 2021) is nominative, firm, definitive and non-modifiable (no change of route and / or date and / or time and / or participant). No refund, even partial, will be applied once the online payment has been made.



Article 3 - withdrawal of the commitment package and frame sticker

Your final registration will be made against delivery of vouchers at the Festival village in Tournus, banks of the Saône:

  1. for the Saturday route: July 10 according to the times defined by route:

    • "Les Boit sans Soif" (departure at 10:00 am): Saturday July 10 from 9:00 am to 10:00 am

  2. for the Sunday route: July 11 according to the times defined by route:

    • "Les Ventres Jaunes" (departure at 10:00 am): Sunday July 11 from 9:00 am to 10:00 am

Article 4 - image rights

Acceptance of these rules necessarily implies that the participant agrees to the organizers, the media and the social networks covering the event to use his image which may appear in the photographs or videos taken on Saturday, July 10, 2021, 9 a.m., to Sunday July 11, 2021, 7 p.m. This authorization is valid for the whole world, for any use intended to ensure the promotion of the Bourgogne Vélo Festival and in all its forms (video films, press, websites, social networks, etc.). The use of these images may in no case infringe the privacy or reputation of the participant.

The acceptance of the rules necessarily implies that the legal representatives of a minor participant give their consent to the association "Ride in the Red Zone" to the media and social networks covering the event to use their image which may appear in photographs or videos taken from Saturday July 10, 2021, 9 a.m. to Sunday July 11, 2021, 7 p.m. The use of these images may in no case infringe the privacy or reputation of the child.

In accordance with the law of 06.01.1978, participants have the right to access, rectify and oppose the processing of data concerning them by justifying their identity to the association "Ride in the Red Zone ".

This authorization is valid for the duration of copyright from July 10, 2021, 9:00 a.m.

Article 5 - safety and mechanical assistance

The Bourgogne Vélo Festival is not a sports competition within the meaning of the provisions of the Sports Code, in particular its articles R.331-6 and R.331-13. Each participant must comply with the highway code and the specific signs for the event, by not straying from the official route. Wearing a helmet is not compulsory but highly recommended. The participant declares to be fit for cycling and releases the organizers from any liability in the event of physical failure or accidents. Participants are responsible for their equipment and release the organizer from any responsibility in the event of theft or damage to the site of the event. The participant also undertakes to respect the flora and fauna and not to leave any rubbish on the course and its outbuildings. The participants undertake to respect all the instructions given by the organizer and the volunteers.

The Bourgogne Vélo Festival is not a sporting competition but rather a cycling excursion. However, it is important that the participants check the scope of the guarantees (and the exclusions) of their possible current insurance (RC). This process is obviously optional but very strongly recommended. It can be done with the insurer of their choice. This insurance will guarantee the payment of a capital in the event of bodily injury (death or disability) when the insured has been the victim of an accident during his participation in the event.



On Saturday July 10 and Sunday July 11, 2021, in the event of mechanical or bodily incidents, it is the emergency services, which intervene on public roads, who will then be notified. The participants will have on their roadmap, the main telephone numbers to contact in case of emergency:

  • Telephone number of the organization (written on the roadmap given to each participant),

  • 112: N ° for all cellphones,

  • 18: Firemen N °,

  • 15: N ° Samu.

In the event of abandonment, the participant can also contact the organization's emergency number for assistance. No flying or fixed mechanical assistance will be implemented on the proposed routes.

Article 6 - refreshments

Two refreshment points will be offered on each route of the Bourgogne Vélo Festival taking place on Saturday 10 and Sunday 11 July 2021. A snack will also be offered to each participant on his arrival against delivery of his roadmap.

Article 7 - information

All information relating to the event is regularly updated on: www.bourgognevelofestival.com.

Article 8 - processing of personal data

Participants are informed that the personal data collected is subject to computer processing intended exclusively to allow the organization of the "Bourgogne Vélo Festival" event. The "Ride in the Red Zone" association, responsible for processing, undertakes not to communicate the personal data thus collected to third parties.
In accordance with the law "Informatique et Libertés" n ° 78-17 of January 6, 1978 amended by law n ° 2004-801 of August 6, 2004, participants have the right to access and rectify information. concerning. They can thus send a letter to the following address: Association Ride in the Red Zone - 14 Chemin du Trou à Glaise 78540 VERNOUILLET. They may also, for legitimate reasons, oppose the processing of data concerning them.
The information communicated by the customer on the occasion of his reservation will not be transmitted to any third party. This information will be considered confidential. They will be used only by internal departments to process the reservation and to strengthen and personalize communication and the offer of services reserved for customers.

Article 9 - cancellation of the event

The total or partial cancellation of the event will be considered by the parties as a case of force majeure and will not result in a refund of the sums already paid by the participants. In the event of total or partial cancellation before the start of the event, the organizer undertakes to inform the participants.



Article 10 - specific regulation

Article 10.1 - Use of public roads

10.1.1 - Choice of routes

The proposed routes take roads without any particular danger and low traffic, designed according to the requirements of the various local authorities for safety reasons. The participant must not stray from the official route.

10.1.2 - Flow of participants

The courses are carried out at a free pace, without classification or performance measurement. This is not a competition. The two routes proposed on the one hand as well as the planned staggering of the departures of each group on the other hand are likely to facilitate the flow of participants in traffic and avoid the effect of massive peloton. The start of each hike will be grouped at the time indicated. The evolution of the flow of participants will evolve according to the rhythm of each one.

10.1.3 - Marking on public roads

Temporary marking of the courses is carried out with spray paint cans, in accordance with the regulations. The disappearance of this temporary marking is carried out either naturally or by the care of the association "Ride in the Red Zone", and this at the latest within 72 hours after the end of the event.

Article 10.2 - Safety and prevention

10.2.1 - Supervision system

The security system put in place by the organizer for Saturday July 10 and Sunday July 11, 2021 can be found in article 5 of these regulations.

10.2.2 - Wearing a helmet and daytime traffic

Wearing a hard shell helmet is strongly recommended and compulsory for minors. Outside built-up areas and in insufficient visibility, wearing a high visibility vest in accordance with the regulations is compulsory.

Article 10.3 - Duties of participants

10.3.1 - Behavior

The participants do not benefit in any case from a priority passage. They must apply the provisions of the Highway Code and those taken by the competent local authorities, to respect the verbal and written instructions of the organizer and the volunteers, to execute the orders of the police or gendarmerie services given. in the interest of road safety and traffic, respect other road users. The personal responsibility of the participant remains full and entire with regard to all of these provisions, prescriptions, instructions and injunctions.

10.3.2 - Cycle equipment

The cycles used by the participants meet the conditions of participation, are equipped in accordance with the provisions of the Highway Code and in working order, in particular with regard to the safety and braking devices.

Article 10.4 - Specificities of the participants

10.4.1 - Identification of participants

A frame sticker and a roadmap are given by the organizer to each duly registered participant.

10.4.2 - Participation of minors

Only minors over the age of 16 are allowed to participate in the Bourgogne Vélo Festival hikes. These, licensed or not from a sports federation, must be accompanied either by a parent or legal guardian, or by a qualified supervisor.

Article 11 - request for information - complaints

All requests for information and / or complaints can be submitted to the "Ride in the Red Zone" association by e-mail at the following address: bourgognevelofestival@hotmail.com

Article 12 - miscellaneous

The fact that any one of these conditions is not invoked at a given time cannot be interpreted as a waiver of the application of these conditions. In the event that any of these conditions is declared null or contrary to a provision of public order, it will be deemed unwritten and the other provisions will remain in force.

Article 13 - applicable law

The sale of this ticket office is governed and subject to French law. For any complaint, the participant can contact customer service at the contact details mentioned in article 11 of these conditions. In the event of a dispute, the French courts have sole jurisdiction.

Article 14 - acceptance of the rules

Participants in the Bourgogne Vélo Festival confirm that they have read the rules and agree to respect all of the above articles.

I accept, without reservation or restriction, all the clauses and waive any recourse against the organizer.

I also certify that my bike is and will be in working order on the day of my participation in the Bourgogne Vélo Festival, and in compliance with the constraints required by the regulations for this event (articles 1.2 and 10.4.2).
